Terms of Service
We are Dude Development LLC, doing business as Hairdaze (“Company,” “we,” “us,” “our”), a limited liability company registered in South Carolina, United States.
We operate the website at hairdaze.app (the “Site”), the mobile application Hairdaze (the “App”), and any related products and services that link to these legal terms (collectively, the “Services”).
You can contact us by email at [email protected].
These Legal Terms are a binding agreement between you and Dude Development LLC concerning your access to and use of the Services. By accessing or using the Services, you agree that you have read, understood, and accepted these Legal Terms. If you do not agree, you must discontinue use immediately.
Hairdaze is not a medical service. It is a tracking and analysis tool for your own haircare. It does not diagnose, treat, cure, or prevent any condition, and it is not a substitute for advice from a doctor, dermatologist, trichologist, or stylist. See Section 3 — please read it.
We will notify you in advance of material changes to these Legal Terms or to the Services. The modified terms take effect when posted, or on the date stated in our notice. By continuing to use the Services after that date, you agree to be bound by them.
The Services are intended for users who are at least 18 years old. If you are under 18, you may not use the Services.
We recommend that you save a copy of these Legal Terms for your records.
1. Our Services
Hairdaze lets you record your haircare routine, the products you use, and how your hair responds, and then analyses your own history to identify patterns and present them to you.
The information provided through the Services is not intended for distribution to, or use by, any person or entity in any jurisdiction where such distribution or use would be contrary to law or would subject us to any registration requirement. Those who access the Services from other locations do so on their own initiative and are responsible for compliance with local law.
The Services are not tailored to comply with industry-specific regulations such as HIPAA or GLBA. If your interactions would be subject to such laws, you may not use the Services.
2. Intellectual property rights
Our intellectual property
We own or licence all intellectual property rights in the Services, including the source code, databases, software, designs, audio, video, text, photographs, and graphics (the “Content”), as well as the trademarks, service marks, and logos (the “Marks”).
The Content and Marks are protected by copyright, trademark, and other laws. They are provided “AS IS” for your personal, non-commercial use only.
Your use of our Services
Subject to your compliance with these Legal Terms, we grant you a non-exclusive, non-transferable, revocable licence to access the Services and to download or print portions of the Content to which you have properly gained access, solely for your personal, non-commercial use.
No part of the Services, Content, or Marks may be copied, reproduced, republished, sold, licensed, or otherwise exploited for any commercial purpose without our prior written permission. Requests may be sent to [email protected].
If you breach these intellectual property rights, your licence terminates immediately.
3. No medical advice
In short: Hairdaze describes patterns in what you have recorded. It is not a medical device, not a diagnosis, and not advice from a professional.
The Services are for general informational and self-tracking purposes only. Hairdaze is not a medical device, does not provide medical, dermatological, or other professional advice, and is not intended to diagnose, treat, cure, or prevent any disease or condition.
The insights the Services produce are statistical correlations drawn from your own logs. A correlation is not a cause. The Services may report that something has tended to accompany something else in your history; they do not establish that one produced the other, and they cannot account for factors you have not recorded.
Where the Services suggest consulting a stylist, trichologist, or clinician — for example, after you have repeatedly logged significant breakage — that is a prompt to seek a professional opinion, not an assessment of your health.
Always seek the advice of a qualified professional with any questions about a medical or dermatological condition. Never disregard professional advice, or delay seeking it, because of something you read in the Services. If you believe you have a medical emergency, contact your local emergency services immediately.
You use the Services, and act on anything you learn from them, at your own risk.
4. Your content and your data
You own the data you record. Your logs, hair profile, product shelf, notes, and photographs remain yours. We do not claim ownership of them.
You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, and process that data solely to operate and provide the Services to you — including running our analysis over your history and generating insights for you. This licence exists so that we can run the app; it gives us no right to use your data for any other purpose.
We handle your data as described in our Privacy Policy, which forms part of these Legal Terms.
You can export your data or delete your account at any time in Profile › Privacy & Data. Deleting your account deletes your data as described in the Privacy Policy.
We may create and use aggregated or de-identified information that does not identify you or any individual — for example, counts of how often a feature is used — to operate, secure, and improve the Services. We will not attempt to re-identify such information.
5. User representations
By using the Services, you represent and warrant that:
- All registration information you submit is true, accurate, current, and complete, and you will keep it so;
- You have legal capacity and agree to comply with these Legal Terms;
- You are at least 18 years old;
- You will not access the Services through automated or non-human means;
- You will not use the Services for any illegal or unauthorised purpose; and
- Your use will not violate any applicable law or regulation.
If you provide information that is untrue, inaccurate, or incomplete, we may suspend or terminate your account and refuse any current or future use of the Services.
6. User registration
You must register to use the Services. You agree to keep your password confidential and are responsible for all activity under your account. We may remove, reclaim, or change a username we determine is inappropriate, obscene, or otherwise objectionable.
7. Purchases and payment
Purchases are made through the Apple App Store and are subject to Apple's terms. We do not receive or store your payment card details.
You agree to provide current, complete, and accurate purchase information as required by Apple, and to pay all charges at the prices then in effect. All payments are in US dollars unless the App Store presents otherwise for your region.
We reserve the right to correct pricing errors, to limit or cancel quantities, and to refuse any order at our sole discretion.
8. Subscriptions
Billing and renewal
Subscriptions are billed through your Apple ID account and renew automatically at the end of each period unless cancelled. Your account is charged within 24 hours before the current period ends.
Free trial
Where we offer a free trial, any unused portion is forfeited if you purchase a subscription during the trial. Unless you cancel at least 24 hours before the trial ends, the subscription begins and your account is charged.
Cancellation
You cancel through your Apple ID settings — Settings › [your name] › Subscriptions — not through us. We cannot cancel an App Store subscription on your behalf. Cancellation takes effect at the end of the current paid period; you keep access until then.
Refunds
Refunds for App Store purchases are handled by Apple under Apple's policies. Requests should be made to Apple. Nothing here limits any refund right you have under mandatory consumer law in your country.
If you are a consumer in the UK or EEA
You normally have a 14-day right to withdraw from a contract for digital content. By starting to use a subscription or free trial immediately, you request immediate performance and acknowledge that you lose the right of withdrawal once performance has begun, to the extent permitted by law. This does not affect your statutory rights in respect of digital content that is faulty or not as described.
Price changes
We may change subscription prices. We will give you reasonable advance notice, and where required by law or by the App Store, we will ask for your consent before a change takes effect. If you do not accept, you may cancel before the change applies.
9. Apple App Store terms
The following applies where you obtained the App from the Apple App Store, and Apple is a third-party beneficiary of these Legal Terms with the right to enforce them against you:
- These Legal Terms are between you and us only, not with Apple. Apple is not responsible for the App or its content.
- Your licence to use the App is limited to use on an Apple-branded device you own or control, as permitted by the App Store Terms of Service.
- Apple has no obligation to furnish maintenance or support for the App.
- If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation.
- Apple is not responsible for addressing any claim by you or a third party relating to the App, including product liability claims, claims that the App fails to conform to a legal or regulatory requirement, and claims under consumer protection or similar legislation.
- Apple is not responsible for investigating, defending, settling, or discharging any third-party claim that the App infringes intellectual property rights.
- You represent that you are not located in a country subject to a US Government embargo or designated as “terrorist supporting,” and that you are not on any US Government list of prohibited or restricted parties.
10. Mobile application licence
We grant you a revocable, non-exclusive, non-transferable, limited right to install and use the App on a device you own or control, strictly in accordance with these Legal Terms. You may not:
- Decompile, reverse engineer, disassemble, or attempt to derive the source code of the App, except to the extent applicable law prohibits this restriction;
- Modify or create derivative works of the App;
- Remove or alter any proprietary notice;
- Use the App to create a product or service that competes with it;
- Make the App available over a network where it could be used by multiple devices at once;
- Use the App to send automated queries or unsolicited commercial email; or
- Use our proprietary information or interfaces in the design or development of another application.
11. Prohibited activities
You may use the Services only for their intended purpose. You agree not to:
- Retrieve data or content to create or compile a collection, database, or directory without our permission;
- Circumvent, disable, or interfere with security-related features of the Services;
- Defraud or mislead us or other users, particularly in an attempt to obtain account information;
- Disparage or otherwise harm us or the Services;
- Use information obtained from the Services to harass, abuse, or harm another person;
- Misuse our support services or submit false reports;
- Use the Services in a manner inconsistent with applicable law;
- Engage in unauthorised framing of or linking to the Services;
- Upload viruses, Trojan horses, or other material that interferes with the operation of the Services;
- Use scripts, bots, scrapers, or other automated means to access or use the Services;
- Remove copyright or other proprietary notices;
- Impersonate another user, or use another user's username or password;
- Interfere with or create an undue burden on the Services or the networks connected to them;
- Harass, intimidate, or threaten our employees or agents;
- Attempt to bypass measures designed to prevent or restrict access;
- Copy or adapt the software of the Services;
- Use the Services for any revenue-generating endeavour or commercial enterprise without our authorisation; or
- Sell or otherwise transfer your profile.
12. User contributions
The Services allow you to create content — logs, notes, photographs, product entries, and support messages (“Contributions”). Contributions are described further in Section 4.
By submitting a Contribution you represent that: you own it or have the necessary rights; it does not infringe anyone's rights; it is not false, misleading, harassing, defamatory, obscene, or otherwise unlawful; and you have obtained any consent needed from anyone depicted in it.
We may, but are not obliged to, remove Contributions that violate these Legal Terms.
13. Services management
We reserve the right, but not the obligation, to monitor the Services for violations of these Legal Terms; to take appropriate legal action against anyone who violates them; to refuse, restrict, or disable access to any Contribution; to remove files that are excessive in size or burdensome to our systems; and otherwise to manage the Services to protect our rights and property and the proper functioning of the Services.
14. Privacy policy
We care about data privacy and security. Please review our Privacy Policy and, if you are a Washington or Nevada resident, our Consumer Health Data Privacy Policy. By using the Services, you agree to be bound by them, and they are incorporated into these Legal Terms.
The Services are hosted in the United States. If you access them from elsewhere, you are transferring your data to the United States and you consent to it being processed there.
15. Term and termination
These Legal Terms remain in effect while you use the Services.
We may suspend or terminate your access at any time, without notice or liability, for any reason, including breach of these Legal Terms. We may also delete any content you have posted. If we terminate your account, you may not create a new one under your name, a false name, or the name of a third party.
You may terminate at any time by deleting your account in Profile › Privacy & Data. Termination does not entitle you to a refund of amounts already paid, except where required by law or by Apple's policies.
16. Modifications and interruptions
We may change, modify, or remove the contents of the Services at any time, and we have no obligation to update any information. We will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Services.
We cannot guarantee that the Services will be available at all times. Hardware, software, and other problems may result in interruptions, delays, or errors. We reserve the right to change, revise, update, suspend, or discontinue the Services at any time without notice. Nothing in these Legal Terms obliges us to maintain or support the Services.
You are responsible for keeping your own copies of important data. Exporting your data periodically is recommended, and the tools to do so are in the app.
17. Governing law
These Legal Terms are governed by and construed in accordance with the laws of the State of South Carolina, without regard to its conflict of law principles.
If you are a consumer resident in the UK, the EEA, or another jurisdiction whose law provides mandatory consumer protections, nothing in these Legal Terms deprives you of the protection of the mandatory provisions of the law of your country of residence, and you may bring proceedings in the courts of that country.
18. Dispute resolution
Informal resolution first
Before filing a claim, you agree to try to resolve the dispute informally by contacting us at [email protected]. We will try in good faith to resolve it with you. If we cannot within 30 days, either party may proceed formally.
Binding arbitration (United States residents only)
If informal resolution fails, any dispute arising out of or relating to these Legal Terms or the Services will be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. Arbitration will take place in York County, South Carolina, or, at your election, by telephone, video, or on the documents alone, or in the county where you reside.
Class action waiver. You and we each agree that claims will be brought only in an individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding.
Your right to opt out. You may opt out of this arbitration agreement by emailing [email protected] with “Arbitration Opt-Out” in the subject line within 30 days of first accepting these Legal Terms. Opting out will not affect any other part of these Legal Terms, and will not affect your use of the Services.
Exceptions
Arbitration does not apply to: claims that may be brought in small claims court; claims seeking injunctive relief for infringement or misuse of intellectual property; or any dispute where arbitration or the class waiver is unenforceable under applicable law.
This Section 18 does not apply to consumers resident in the UK or EEA, who may bring proceedings in their local courts as set out in Section 17.
19. Corrections
The Services may contain typographical errors, inaccuracies, or omissions. We reserve the right to correct them and to update information at any time without prior notice.
20. Disclaimer
THE SERVICES ARE PROVIDED ON AN “AS-IS” AND “AS-AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE MAKE NO WARRANTY ABOUT THE ACCURACY OR COMPLETENESS OF THE SERVICES' CONTENT, INCLUDING ANY INSIGHT, CORRELATION, OR RECOMMENDATION THE SERVICES PRODUCE, AND WE ASSUME NO LIABILITY FOR ANY ERROR OR INACCURACY IN THEM, FOR ANY PERSONAL INJURY OR PROPERTY DAMAGE RESULTING FROM YOUR ACCESS TO OR USE OF THE SERVICES, FOR ANY UNAUTHORISED ACCESS TO OUR SERVERS, FOR ANY INTERRUPTION OF TRANSMISSION, OR FOR ANY LOSS OR DAMAGE ARISING FROM CONTENT TRANSMITTED THROUGH THE SERVICES.
WE DO NOT WARRANT THAT THE SERVICES WILL MEET YOUR REQUIREMENTS, THAT THEY WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY PATTERN THE SERVICES IDENTIFY WILL HOLD IN FUTURE OR WILL APPLY TO YOU.
Nothing in these Legal Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded under applicable law. If you are a consumer, your statutory rights are not affected.
21. Limitations of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR LOST DATA, ARISING FROM YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY.
NOTWITHSTANDING ANYTHING TO THE CONTRARY, OUR TOTAL LIABILITY TO YOU FOR ANY CAUSE AND REGARDLESS OF THE FORM OF ACTION WILL AT ALL TIMES BE LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE SIX MONTHS BEFORE THE CLAIM AROSE, OR USD 100.00.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, some or all of the above may not apply to you, and you may have additional rights.
22. Indemnification
You agree to defend, indemnify, and hold us harmless from any loss, damage, liability, claim, or demand, including reasonable legal fees, made by a third party due to or arising out of: your Contributions; your use of the Services; your breach of these Legal Terms; any breach of your representations and warranties; or your violation of the rights of a third party.
We reserve the right, at your expense, to assume the exclusive defence and control of any matter for which you are required to indemnify us, and you agree to cooperate with that defence.
23. Electronic communications and signatures
Visiting the Services, emailing us, and completing forms constitute electronic communications. You consent to receive communications electronically, and you agree that electronic notices, agreements, and records satisfy any legal requirement that such communications be in writing.
You consent to the use of electronic signatures and to the electronic delivery of notices and records, and you waive any requirement for original non-electronic records, to the extent permitted by applicable law.
24. California users and residents
If a complaint is not satisfactorily resolved, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, California 95834, or by telephone at (800) 952-5210 or (916) 445-1254.
25. Miscellaneous
These Legal Terms, together with any policies we post, constitute the entire agreement between you and us. Our failure to exercise or enforce any right or provision does not operate as a waiver.
We may assign our rights and obligations at any time. We are not responsible for any loss, damage, delay, or failure to act caused by anything beyond our reasonable control.
If any provision is determined to be unlawful, void, or unenforceable, that provision is severable and does not affect the validity and enforceability of the remaining provisions.
No joint venture, partnership, employment, or agency relationship is created between you and us. You agree that these Legal Terms will not be construed against us by virtue of having drafted them.
